Speech categories are defined by multiple acoustic dimensions and their boundaries are generally fuzzy and ambiguous in part because listeners often give differential weighting to these cue dimensions during phonetic categorization. This study explored how a listener's perception of a speaker's socio-indexical and personality characteristics influences the listener's perceptual cue weighting. In a matched-guise study, three groups of listeners classified a series of gender-neutral /b/-/p/ continua that vary in VOT and F0 at the onset of the following vowel. Listeners were (...) assigned to one of three prompt conditions and rated the talker in terms of vocal gender prototypicality, attractiveness, friendliness, confidence, trustworthiness, and gayness. Male listeners and listeners who saw a male face showed less reliance on VOT compared to listeners in the other conditions. Listeners' visual evaluation of the talker also affected their weighting of VOT and onset F0 cues, although the effects of facial impressions differ depending on the gender of the listener. The results demonstrate that individual differences in perceptual cue weighting are modulated by the listener's gender and his/her subjective evaluation of the talker. These findings lend support for exemplar-based models of speech perception and production where socio-indexical features are encoded as a part of the episodic traces in the listeners' mental lexicon. This study also shed light on the relationship between individual variation in cue weighting and community-level sound change by demonstrating that VOT and onset F0 co-variation in North American English has acquired a certain degree of socio-indexical significance. Recent studies have documented substantial variability among typical listeners in how gradiently they categorize speech sounds, and this variability in categorization gradience may link to how listeners weight different cues in the incoming signal. The present study tested the relationship between categorization gradience and cue weighting across two sets of English contrasts, each varying orthogonally in two acoustic dimensions. Participants performed a four‐alternative forced‐choice identification task in a visual world paradigm while their eye movements were monitored. We found that (a) (...) greater categorization gradience derived from behavioral identification responses corresponds to larger secondary cue weights derived from eye movements; (b) the relationship between categorization gradience and secondary cue weighting is observed across cues and contrasts, suggesting that categorization gradience may be a consistent within‐individual property in speech perception; and (c) listeners who showed greater categorization gradience tend to adopt a buffered processing strategy, especially when cues arrive asynchronously in time. The study examines the ontological similarity between the concept of competitor orientation and questionable intelligence-gathering efforts. Respondents from the hotel industry were surveyed with self-administered questionnaires. Exploratory factor analysis was carried out to identify the structure underlying variables of market orientation and ethical judgment on questionable intelligence-gathering efforts. The results suggest that the surveyed hotel managers are unable to distinguish the legitimate tactics of competitor orientation from the questionable practice of industrial espionage.

Pluractionality (PLR) is the morphological category that generally signifies multiple actions. This paper, based on original fieldwork, provides the first investigation of PLR in Chechen, a Nakh language spoken in the eastern central part of the North Caucasus. The data reflects the standard dialect of Chechen spoken in and near the cities of Murus-Martan and Grozny. Chechen PLR, which is marked by stem vowel alternations, prototypically signifies the repetition of an event (e.g., saca/sieca `to stop once/many times'; laaca/liica `to catch (...) once/many times'). The plurality of the nominative argument can affect the interpretation of some verbs (e.g., ghitta `to wake up'; hitta `to assume a standing position'), rendering the reading distributive. More interestingly, a durative reading, signaling the prolongation of an event, is available for some verbs (e.g., xouzha/xiizha `to ache momentarily/for a while', zouza/ziiza `to itch momentarily/for a while') but not others. Following Ojeda (1998) and Lasersohn (1995), PLR is accounted for in terms of the pluralization of the event argument of a predicate. The various semantic effects are the results of interactions between the aspectual properties of individual verbs and event pluralization. (shrink)

First published in 1975, this is a book of general intellectual interest about the role of the university in contemporary society and that of university teachers in relation to their subjects, their students, and their wider political commitments. Alan Montefiore offers preliminary analyses of the family of concepts most often invoked in discussions of these problems, taking the central dispute to be between those who hold a 'liberal' view of the university and those who regard this notion as illusory, (...) dishonest or undesirable. Six academics, representing, discuss issues of substantive conflict in light of Montefiore's initial distinctions. The volume is of particular interest to students of political and social philosophy, and political and educational theory. Little research has explored the perceptions of military medical providers in the deployed environment and how their perceptions may change over time across an extended military conflict. To our knowledge, no studies have examined military medical providers’ opinions on readiness for their roles in the post-9/11 contingency operations. What has been published indicates that, during the height of Operation Iraqi Freedom, military medical providers often deployed with little notice and minimal formal training. The present report examines data obtained from multiple (...) cohorts of military medical providers (N = 321) deployed to Iraq between 2005 and 2009. Despite varying degrees of support from the U.S. public, our findings indicate that U.S. Air Force military medical providers’ support for the people of Iraq, their belief in the mission, and their ability to influence change did not vary with time. In the essay On Liberty , Mill put forward his famous principle that society may only interfere with those actions of an individual which concern others and not with actions which merely concern himself. The validity of this principle depends on there being a distinction between self-regarding and other-regarding actions. But the concept of self-regarding actions has been severely criticised on the ground that all actions affect others in some way and are therefore other-regarding. The notion of self-regarding actions appears (...) to be completely discredited. Very recently, however, there has been some dissatisfaction with the traditional debunking of Mill on this score. Two serious and important attempts to reinterpret the principle were made by Mr J. C. Rees in an article entitled ‘A Re-Reading of Mill on Liberty’, and by Mr Alan Ryan in two brief but extremely useful contributions. My aim is to discuss these reinterpretations of Mill, and on the basis of this, build up what I think is the correct account of Mill's notion of self-regarding actions. (shrink)

Many philosophers of biology have embraced a version of pluralism in response to the failure of theory reduction but overlook how concepts, methods, and explanatory resources are in fact coordinated, such as in interdisciplinary research where the aim is to integrate different strands into an articulated whole. This is observable for the origin of evolutionary novelty—a complex problem that requires a synthesis of intellectual resources from different fields to arrive at robust answers to multiple allied questions. It is an apt (...) locus for exploring new dimensions of explanatory integration because it necessitates coordination among historical and experimental disciplines . These coordination issues are widespread for the origin of novel morphologies observed in the Cambrian Explosion. Despite an explicit commitment to an integrated, interdisciplinary explanation, some potential disciplinary contributors are excluded. Notable among these exclusions is the physics of ontogeny. We argue that two different dimensions of integration—data and standards—have been insufficiently distinguished. This distinction accounts for why physics-based explanatory contributions to the origin of novelty have been resisted: they do not integrate certain types of data and differ in how they conceptualize the standard of uniformitarianism in historical, causal explanations. Our analysis of these different dimensions of integration contributes to the development of more adequate and integrated explanatory frameworks. (shrink)

The concept of evolvability—the capacity of a population to produce and maintain evolutionarily relevant variation—has become increasingly prominent in evolutionary biology. Paleontology has a long history of investigating questions of evolvability, but paleontological thinking has tended to neglect recent discussions, because many tools used in the current evolvability literature are challenging to apply to the fossil record. The fundamental difficulty is how to disentangle whether the causes of evolutionary patterns arise from variational properties of traits or lineages rather than being (...) due to selection and ecological success. Despite these obstacles, the fossil record offers unique and growing sources of data that capture evolutionary patterns of sustained duration and significance otherwise inaccessible to evolutionary biologists. Additionally, there exist a variety of strategic possibilities for combining prominent neontological approaches to evolvability with those from paleontology. We illustrate three of these possibilities with quantitative genetics, evolutionary developmental biology, and phylogenetic models of macroevolution. In conclusion, we provide a methodological schema that focuses on the conceptualization, measurement, and testing of hypotheses to motivate and provide guidance for future empirical and theoretical studies of evolvability in the fossil record. Biological ontologies are used to organize, curate, and interpret the vast quantities of data arising from biological experiments. While this works well when using a single ontology, integrating multiple ontologies can be problematic, as they are developed independently, which can lead to incompatibilities. The Open Biological and Biomedical Ontologies Foundry was created to address this by facilitating the development, harmonization, application, and sharing of ontologies, guided by a set of overarching principles. One challenge in reaching these goals was that the (...) OBO principles were not originally encoded in a precise fashion, and interpretation was subjective. Here we show how we have addressed this by formally encoding the OBO principles as operational rules and implementing a suite of automated validation checks and a dashboard for objectively evaluating each ontology’s compliance with each principle. This entailed a substantial effort to curate metadata across all ontologies and to coordinate with individual stakeholders. We have applied these checks across the full OBO suite of ontologies, revealing areas where individual ontologies require changes to conform to our principles. Our work demonstrates how a sizable federated community can be organized and evaluated on objective criteria that help improve overall quality and interoperability, which is vital for the sustenance of the OBO project and towards the overall goals of making data FAIR. The effect of uniform lighting on face identity processing is little understood, despite its potential influence on our ability to recognize faces. Here, we investigated how changes in uniform lighting level affected face identification performance during face memory tests. Observers were tasked with learning a series of faces, followed by a memory test where observers judged whether the faces presented were studied before or novel. Face stimuli were presented under uniform bright or dim illuminations, and lighting across the face learning (...) and the memory test sessions could be the same or different. This led to four experimental conditions: Bright/Dim ; Bright/Bright; Dim/Bright; and Dim/Dim. Our results revealed that incongruent lighting levels across sessions significantly reduced sensitivity to faces and introduced conservative biases compared to congruent lighting levels. No significant differences in performance were detected between the congruent lighting conditions and between the incongruent lighting conditions. Thus, incongruent lighting deteriorated performance in face identification. These findings implied that the level of uniform lighting should be considered in an illumination-specific face representation and potential applications such as eyewitness testimony. (shrink)

The Ontology for Biomedical Investigations (OBI) is an ontology that provides terms with precisely defined meanings to describe all aspects of how investigations in the biological and medical domains are conducted. OBI re-uses ontologies that provide a representation of biomedical knowledge from the Open Biological and Biomedical Ontologies (OBO) project and adds the ability to describe how this knowledge was derived. We here describe the state of OBI and several applications that are using it, such as adding semantic expressivity to (...) existing databases, building data entry forms, and enabling interoperability between knowledge resources. OBI covers all phases of the investigation process, such as planning, execution and reporting. It represents information and material entities that participate in these processes, as well as roles and functions. Prior to OBI, it was not possible to use a single internally consistent resource that could be applied to multiple types of experiments for these applications. OBI has made this possible by creating terms for entities involved in biological and medical investigations and by importing parts of other biomedical ontologies such as GO, Chemical Entities of Biological Interest (ChEBI) and Phenotype Attribute and Trait Ontology (PATO) without altering their meaning. OBI is being used in a wide range of projects covering genomics, multi-omics, immunology, and catalogs of services. OBI has also spawned other ontologies (Information Artifact Ontology) and methods for importing parts of ontologies (Minimum information to reference an external ontology term (MIREOT)). The OBI project is an open cross-disciplinary collaborative effort, encompassing multiple research communities from around the globe. To date, OBI has created 2366 classes and 40 relations along with textual and formal definitions. The OBI Consortium maintains a web resource providing details on the people, policies, and issues being addressed in association with OBI. (shrink)

Kurrâ’ya nispet edilen aynı kelimelerdeki edâ farklılıklarının tartışmalara sebep olmasından ötürü kıraat ihtilafı olan kelimelerde ihticâc yapılmasına gereksinim duyulmuştur. Delil getirmek manasında kullanılan ihticâc kavramı, kıraat ihtilafları için söz konusu olduğunda ise kıraat ihtilaflarının sıhhat zemininin ortaya konması kastedilmektedir. Ayrıca 2. asrın sonlarında kıraat tevcîhlerinin yapıldığı müstakil eserler ortaya çıkmakla birlikte kıraat alan yazınına ait genel telifatlarda da kıraat ihticâclarının yapıldığı görülmektedir. Kıraat müelliflerinden biri olan İbnu’l-Cezerî de Neşru’l-ḳırââti’l-‘aşr adlı eserinde zaman zaman kıraat ihticâcına yer vermektedir. Mezkûr eserdeki kıraat (...) ihticâcları hakkında tespit edilebildiği kadarıyla yapılmış tek bir çalışma bulunmaktadır. Fakat bu çalışmada, kıraatten ve bunun dışındaki disiplinlerden yeterince istifade edilmediği belirlenmiştir. Ayrıca selef ulemasının Neşru’l-ḳırââti’l-‘aşr adlı esere ihticâc konusunda etkisi özelinde bir çalışmaya da rastlanmamıştır. Buradan hareketle elinizdeki bu çalışmada, İbnu’l-Ce-zerî’nin kıraat ihticâcına dair uygulamaları Neşru’l-ḳırââti’l-‘aşr adlı eser özelinde incelenmiş, me‘âni’l-Kur’ân ve me‘âni’l-kıraat literatürlerinin ortaya çıktıkları dönem dikkate alınarak h. 2.-4. asırlarda kaleme alınan bu literatürlere ait eserlerin İbnu’l-Cezerî’ye ait kıraat tevcîhlerine etkisinin olup olmadığı araştırılmıştır. Çalışmanın neticesinde İbnu’l-Cezerî’nin yaptığı kıraat tevcîhlerinden ele alınanların bir kısmına, söz konusu üç asırda kaleme alınan me‘âni’l-Kur’ân ve me‘âni’l-kıraat telifatında ekseriyetle yer verilmediği saptanmıştır. İbnu’l-Cezerî’nin ise kıraat ihtilafının olmadığı yerlerde dahi ilgili edâ için ihticâc yaptığı müşahede edilmiştir. Buna ilaveten İbnu’l-Cezerî’nin Neşr’de yaptığı ihticâc uygulamalarının me‘âni’l-Kur’ân ve me‘âni’l-kıraat telifatında yapılan ihticâc işlemleriyle benzeştiği görülmüştür. : In earlier work, Bernard R. Goldstein and the present author have introduced a procedural rule for historical inquiry, which requires that one take pains to establish the credibility of any citation of ancient thought by later writers in antiquity through a process of verification. In this paper, I shall apply what I call the Rule of Ancient Citations to Simplicius' interpretation of Aristotle's remarks in Meta L. 8, which is the primary point of departure for the modern understanding of (...) Greek planetary theory. I first sketch several lines of argument that lead me to conclude that Simplicius' interpretation should not be accepted because it assumes a concern with planetary phenomena unknown to the Greeks before the late 2nd and early 1st centuries BC. Then, after showing that there is a fairly well defined range of readings of Aristotle's remarks more in keeping with what we actually know of astronomy in the 5th and 4th centuries BC, I conclude that neither Aristotle's report about the Eudoxan and Callippan accounts of the celestial motions nor Simplicius' interpretation of this report is a good starting point for our understanding of early Greek planetary theory. Physicians were in charge of the clinic, the Operating room, and the health care team, responsible - and held accountabl- for all that happened within the scope of their supervision. This grant of responsibility (...) carried with it a corresponding grant of authority; like the ship's captain, the physician was answerable to no one regarding the practice of his art. However compelling the metaphor, few would disagree that the mandate accorded to the medical profession by society is changing. As a result of pressures from a number of diverse directions - including technological advances, the development of new health professionals, changes in health care financing and delivery, the recent emphasis on consumer choice and patients' rights - what our society expects phy- cians to do and to be is different now. The purpose of this volume is to examine and evaluate the conceptual foundations and the moral imp- cations of that difference. School choice has lately risen to the top of the list of potential solutions to America's educational problems, particularly for the poor and the most disadvantaged members of society. Indeed, in the last few years several states have held referendums on the use of vouchers in private and parochial schools, and more recently, the Supreme Court reviewed the constitutionality of a scholarship program that uses vouchers issued to parents. While there has been much debate over the empirical and methodological aspects (...) of school choice policies, discussions related to the effects such policies may have on the nation's moral economy and civil society have been few and far between. Une des réactions qui m’a le plus surpris suite à la publication, avec Alan Sokal, d’ Impostures intellectuelles (1), c’est l’accusation qui nous a été faite d’être « positivistes ». En effet, nulle part nous ne défendons cette doctrine et, les rares fois où nous en parlons, c’est pour la critiquer. Néanmoins j’ai vite compris qu’il fallait distinguer entre positivisme et « positivisme », c’est-à-dire entre une doctrine philosophique complexe ayant prospéré à une certaine époque et à laquelle plus (...) personne n’adhère, du moins dans son intégralité, et une épithète qui est utilisée pour discréditer l’adversaire (2). Dans cet article, je voudrais brièvement expliquer certains aspects du positivisme tel qu’il a réellement existé, les difficultés que cette doctrine a rencontrées et l’héritage de cette tradition qui me semble défendable (et qui est en général facilement discrédité grâce à l’utilisation du label « positiviste »). Je me limiterai au positivisme « anglo-saxon », c’est-à-dire au Cercle de Vienne et à ses successeurs, qui est à la fois plus récent et plus influent, à l’échelle mondiale, que celui de Comte. Yer yüzündeki diller arasında Türkçenin yerine baktığımızda, Ural-Altay dil (...) grubunun Altay koluna bağlı bir dil olduğu ve geçmişinin M.Ö. 4000’li yıllara indiği görülür. Bu tarihten, M.Ö. 5. yüzyıla kadar olan dönem genel olarak Altay veya Proto-Türk devri olarak adlandırılır. Bu dönemde Türkçe ile ilgili az da olsa birtakım dil kalıntılarına rastlanır; ancak bunun yeterli olmaması ve bu dönemden bize yazılı herhangi bir metnin ulaşmaması, bu çağların karanlık dönem olarak adlandırılmasına neden olmuştur. Bu dönemde Türkçenin Çuvaşça ve Yakutça ile henüz ayrılmadığı, hattâ daha eskiye gittiğimizde Moğol, Mançu, Tunguz dilleriyle aynı çatı altında toplandığı varsayılır. Bilindiği gibi daha önce Eski Türkçe döneminin ayrı ayrı metinlerini kapsayan birçok sözlük çalışması yapılmıştır. Ancak bu sözlükler birbirinden bağımsız hazırlanmış, bir kısmı Göktürk dönemi ile Orhun Yazıtlarını, diğer bir kısmı da Uygur dönemi ile bu dönem metinlerini temel almıştır. Eski Türkçe bir bütün olarak düşünüldüğünde, bu sözlüklerin bazı yönlerden yetersiz kaldığı bir gerçektir. Bu çalışmanın genel amacı, daha önce ortaya konulan Eski Türkçe sözlükleri bir araya getirerek Göktürk ve Uygur dönemlerini birlikte ele alan, daha kapsamlı ve tek bir sözlük oluşturmaktır. Lindsay (bio)Throughout 2005, the morbid joke on Capitol Hill was that the twin inevitabilities of "death and taxes" had been replaced by "death politics and taxes." There seemed to be some truth in this observation given the highly publicized intervention by some members of Congress in the Schiavo case and the continuing controversy over government regulation of end-of-life care. The (...) Supreme Court's recent decision in Gonzales v. Oregon (74 U.S.L.W. 4068 (17 January 2006)) has resolved one of the critical issues relating to this controversy by holding that a physician may prescribe controlled substances to provide assistance in dying if such a practice is authorized by state law and not expressly prohibited by federal law. However, other issues remain. In fact, the Court's decision has underscored some of the reasons why there is not only continuing controversy over end-of-life care, but also over other aspects of the practice of medicine. First, it is apparent there is no consensus among health care professionals about the precise boundaries of the legitimate practice of medicine. Second, the regulation of the practice of medicine traverses ill-defined legal territory. In particular, there is significant uncertainty concerning the implications of some regulations as well as the allocation of regulatory authority between and within state and federal governments. This uncertainty leaves substantial room for political maneuvers.Before discussing the politics of medicine, it is worth looking at the regulation of controlled substances in some detail both because this review will provide the necessary background for understanding the ruling in Gonzales v. Oregon and because it will illustrate the uncertainty resulting from multiple sources of regulatory authority.Federal and State Regulation of Controlled SubstancesSince the Pure Food and Drug Act of 1906, the federal government has regulated certain aspects of the distribution and administration of drugs deemed susceptible to abuse. The current primary vehicle for federal regulation is the Comprehensive Drug Abuse Prevention and Control Act, enacted in 1970, of which Title II is known as the Controlled Substances Act (CSA) (21 U.S.C. § 801 et seq.). A [End Page 99] "controlled" substance is just that, a substance that is regulated under the CSA. The CSA classifies controlled substances in five categories or schedules based on their potential for abuse, their accepted medical use, and the risks associated with their use under medical supervision. Schedule I substances have a high potential for abuse and have no currently accepted use in medical treatment. Schedule II-V substances are approved for medical use but are subject to a descending hierarchy of restrictions on their use. To give a lawful prescription for a controlled substance, a physician must be registered with the appropriate federal agency, currently the Drug Enforcement Administration (DEA). Moreover, to be valid, such a prescription must be issued for "a legitimate medical purpose" (21 U.S.C. § 830(b)(3)(A)(ii)).There is little dispute that the primary purposes of the CSA are to control drug abuse and to eliminate illicit trafficking in drugs. In accomplishing these objectives, there is a division of responsibility among various federal agencies, in particular the Department of Health and Human Services and the Department of Justice. Of particular relevance to the controversy in Gonzales v. Oregon is the Attorney General's authority to revoke a physician's registration for prescribing controlled substances if the physician's registration would be inconsistent with the public interest.All 50 states have their own statutes and regulations that address various aspects of the distribution and administration of controlled substances. Most states have adopted versions of the model Uniform Controlled Substances Act, which largely mimics federal law, but several states have placed additional restrictions on a physician's ability to prescribe controlled substances, including time limits on the validity of a prescription and limits on the quantity of a drug that can be prescribed. States are the primary, but by no means the exclusive, source of regulation of medical practice in general. Makalenin konusu Ebû Hanîfe örneğinden hareketle İslam düşüncesinde yargı-siyaset ilişkisi-dir. Ebû Hanîfe’nin yaşadığı döneme kadar karizmanın dini ve siyasi kültürde gelişimine paralel olarak yargı-siyaset ilişkileri bağlamında İslam düşüncesinde bazı formlar çoktan ortaya çık-mıştı. Burada amaç İslam’ın henüz ikinci asrında yargı-siyaset ilişkilerini Ebû Hanîfe üzerinden anlamaya çalışmak ve dolaylı olarak da meselenin bugüne yansıyan yönlerine ışık tutmaktır. Bu yüzden farklı sosyolojik düzlemlerde inşa edilmiş Şiî, Haricî, Sünnî öteki formlar çalışma dışında tutulmuştur. Araştırma Ebû Hanîfe’nin; doktrini oluşturan Kur’an, sünnet ve sahabe uygulamaları (...) ile kendi dönemindeki dini, siyasi, sosyal ve kültürel şartlar arasında nasıl bir okuma yaptığını sorunsallaştırmıştır. Çalışmada Ebû Hanîfe’nin yargı-siyaset ilişkisi bağlamın-da ortaya çıkardığı genel anlama biçiminin, işaret edilen dini ve tarihi şartlarla kendi dini top-lumsallaşma çevresindeki diyalektik bir ilişkide şekillendiği varsayılmıştır. Dolaylı gözlem yöntemi ile elde edilen veriler bir tekil olay incelemesi bağlamında fenomenolojik bir çözüm-lemeye tabi tutulmuştur. Konu bugüne kadar ilahiyat bağlamında olduğu gibi din bilimi alanın-da da dikkat çekici görülmemiştir. Makale İslam düşüncesinde yargı-siyaset ilişkisinin farklı desenleri arasında Ebû Hanîfe modelini tartışması bağlamında bir değere sahip görülebilir. Çalışmada; temel hak ve özgürlüklerin korunması noktasında sivil ve barışçıl bir muhalefetin yeterli olmadığı, iktidarın kişisel hakları tanımaktan daha çok kişisel ödevler ve mutlak itaat talebi ile siyaset yaptığı bir ortamda Ebû Hanîfe’nin soruna ahlaki bir saikle yaklaştığı ve bu bağlamda bir çözüm önerisi getirdiği görülmüştür. Ebû Hanîfe gerek otorite ve karizması ge-rekse ekonomik statüsü ve kültürel birikiminden aldığı güç ile yaşadığı dönemde üst düzey siyasal ve hukuki bir katılım gerçekleştirmiştir. Yasama erkinin özgür bir üyesi olarak Ebû Hanîfe temel haklar bağlamında hayatı boyunca hep iktidarlarla karşı karşıya gelmiş ve bu mücadele içinde iken de öldürülmüştür. Müslüman bir ailede doğmasına rağmen dönemin politik tavrı nedeniyle daha doğumuyla birlikte iktidar tarafından öteki olarak görülmüş ve ömrü boyunca bu statü ile yaşamak zorunda kalmıştır. Başlangıçta kendi ailesi içinde toplum-sallaşırken deneyimlediği mevalilik duygusu, Ebû Hanîfe’de özellikle hocasının ölümünden sonra iktidarlara karşı toplumsal bir hak arayışına dönüşmüştür. Esasen kendi özelinde bir hak arayışı olmaksızın iktidarların yasa ile sorunlu politik tavırları karşısında dini, hukuki ve top-lumsal bir tavır içinde yürüttüğü bu mücadelesi Ehl-i Beyt’i ve diğer bütün toplumsal grup ve kategorileri içine alan bir genişlikte ilerlemiştir. Ebû Hanife’nin yargı- siyaset ilişkisine dair bu yaklaşımı teorik ve pratik olarak tamamen sistematik bir çerçevede şekillenmiştir. İslam hu-kukunun dayandığı bilgi gövdeleri kapsamında o, çok kapsayıcı ve dinamik bir tarzda din ve şeriat kavramsallaştırması yapmıştır. Buna göre Ebû Hanîfe dine temel hakların dayandığı temel yasa anlamı yüklerken şeriata ise kendisinin bu dini alana veya başka bir ifadeyle yasaya göre düzenlendiği neshe açık, değişken bir alan anlamı vermiştir. Bu tevhit eksenli hiyerarşi içinde siyaset, yasaya karşı kesin sorumluluğu olan dünyevi bir alan görülmüştür. Ebû Hanîfe’nin İslam’ın ilk dönemini bir hukuk devleti nosyonu içinde değerlendirdiğinde kuşku yoktur. Buna mukabil, genel yargı-siyaset ilişkisine yaklaşımından anlaşıldığına göre yaşadığı dönemi, iktidarlar tarafından hukukun araçsallaştırıldığı bir dönem olarak görmüştür. Kurmuş olduğu akademi onun yargı-siyaset ilişkisine bakışının önemli bir pratiğidir. Bu akademiden yetişen ve daha sonra resmi ve gayri resmi olarak yasamanın bir üyesi olan öğrencilerine tav-siyeleri ve mektupları, onun bir yargı elemanı olarak siyaset kurumuna yaklaşımının sübjektif değil; bir düzen ihtiyacının ortaya çıkardığı objektif bir tavır olduğunu göstermiştir. Overview The evolution of multicellularity raises questions regarding genomic and developmental commonalities and discordances, selective advantages and disadvantages, physical determinants of development, and the origins of morphological novelties. It also represents a change in the definition of individuality, because a new organism emerges from interactions among single cells. One dark and rainy night, Yuso sexually assaults and tortures Zelan. In escaping from the scene of his crime, he falls heavily and becomes an impotent paraplegic. Instead of treating his fate as divine retribution for his wicked acts, Yuso sees it as sheer bad luck. He shows no remorse for what he has done, and vainly hopes that he will recover his powers, which he now treats as involuntarily hoarded resources to be used on less rainy days. In the (...) presence of others, he pretends that he has turned over a new leaf. He asks for religious and educational books, hoping to make up for his poor education and deprived social background. But he immediately discards them when he is alone in favor of the pornographic magazines which he has bribed a nurse to smuggle in for him. His deception and various obscene acts committed in the hospital are exposed; by the time he comes up for trial, everyone knows that he is still a lustful, sadistic, and unrepentant man. Most retributivists have a sufficient justification for punishing Yuso independently of the social consequences of his punishment. Two features of the case might cause some difficulties. First, Yuso has already experienced considerable suffering and deprivation both before and after his crime, and retributivists might disagree about the relevance of the suffering to his punishment. Secondly, Yuso is unrepentant, and it is unlikely that punishment will change him. This might, as we shall see, create a problem for those who think that the justifying aim of punishment is the moral reform of the offender. (shrink)
